Welcome to Burbrand Marketplace, operated by Sefnal Marketing LLC. These Terms and Conditions govern your access to and use of the Burbrand Marketplace website, ecommerce store, vendor marketplace, print-on-demand products, custom product tools, services, listings, and related features.

By visiting this website, creating an account, purchasing a product, uploading custom content, applying to become a vendor, listing products, or otherwise using Burbrand Marketplace, you agree to these Terms and Conditions. If you do not agree with these Terms, please do not use this website.

1. About Burbrand Marketplace

Burbrand Marketplace is an ecommerce vendor marketplace that sells print-on-demand, personalized, custom, and vendor-supplied products. Products may include apparel, drinkware, wall art, accessories, home décor, gifts, and other customized merchandise.

Some products sold on Burbrand Marketplace may be created, printed, shipped, or fulfilled by third-party vendors, print providers, production partners, or fulfillment companies. Burbrand Marketplace provides the marketplace platform, checkout experience, vendor tools, customer support process, and website experience. Certain products may be designed, sold, produced, or fulfilled by independent vendors or third-party partners.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your location, to make purchases, create an account, open a vendor account, or use this website for business purposes.

By using Burbrand Marketplace, you represent that you have the legal authority to enter into these Terms and to use this website in accordance with all applicable laws.

3. Customer Accounts

You may be required to create an account to purchase products, save designs, communicate with vendors, track orders, or access certain marketplace features.

You agree to provide accurate, complete, and current information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account.

Burbrand Marketplace is not responsible for losses caused by unauthorized use of your account unless required by law.

4. Vendor Accounts

Vendors who sell through Burbrand Marketplace must provide accurate business, payment, product, shipping, tax, and contact information. Vendors are responsible for ensuring that their product listings, descriptions, mockups, images, pricing, customization options, production timelines, and shipping information are accurate and lawful.

Burbrand Marketplace may approve, reject, suspend, remove, or limit vendor accounts or listings at any time if we believe a vendor has violated these Terms, marketplace policies, intellectual property rights, customer trust standards, or applicable law.

Vendors may also be subject to additional vendor agreements, payout policies, commission terms, or marketplace rules.

5. Product Listings

Product listings may include descriptions, images, mockups, size charts, customization options, estimated production times, shipping estimates, and other product details.

We make reasonable efforts to display product information accurately. However, we do not guarantee that colors, textures, dimensions, print placement, sizing, or product appearance will be exactly as shown on your screen.

Colors may vary based on monitor settings, printing methods, material type, fabric type, lighting, and production differences. Minor variations in print placement, color, sizing, and appearance may occur and are not considered defects unless the product is materially different from what was ordered.

6. Print-on-Demand and Custom Products

Many products sold on Burbrand Marketplace are made only after an order is placed. Because print-on-demand and customized products are created specifically for each customer, production may begin shortly after checkout.

Customers are responsible for carefully reviewing all personalization details before placing an order, including names, spelling, dates, photos, messages, colors, sizes, product type, design placement, and uploaded images.

Once an order has entered production, it may not be possible to cancel, change, or refund the order unless the item arrives damaged, defective, misprinted, incorrect, or materially different from what was ordered.

7. Customer-Submitted Content

Customers may upload or submit text, names, photos, images, logos, artwork, messages, or other content for use on custom products.

By submitting content to Burbrand Marketplace, you confirm that:

You own the content or have permission to use it.

The content does not violate copyright, trademark, privacy, publicity, or other rights of any person, brand, business, school, organization, or entity.

The content does not contain illegal, hateful, abusive, threatening, obscene, sexually explicit, defamatory, discriminatory, or harmful material.

The content does not impersonate another person or falsely suggest an affiliation with a brand, school, organization, celebrity, public figure, business, or government entity.

You grant Burbrand Marketplace, its vendors, print providers, production partners, and fulfillment partners permission to use the submitted content solely as needed to create, process, fulfill, ship, support, and display your order.

Burbrand Marketplace may refuse, cancel, remove, or reject any order or content that we believe violates these Terms or may expose Burbrand Marketplace, a vendor, or a fulfillment partner to legal, financial, or reputational risk.

8. Intellectual Property

All content on Burbrand Marketplace, including website design, branding, logos, graphics, product templates, marketplace text, software, designs, photographs, mockups, icons, and other materials, is owned by Burbrand Marketplace, Sefnal Marketing LLC, its vendors, licensors, or content providers and is protected by intellectual property laws.

You may not copy, reproduce, distribute, sell, modify, reverse engineer, scrape, download, or use any marketplace content without written permission, except as allowed by normal website use.

Vendors are responsible for ensuring that any designs, images, fonts, phrases, artwork, product mockups, or listing content they upload, sell, or display do not violate the intellectual property rights of others.

9. Prohibited Products and Content

Burbrand Marketplace may prohibit products, designs, uploads, or listings that include or promote:

Illegal activity
Hate speech or discriminatory content
Harassment, threats, or abuse
Graphic violence or exploitation
Sexually explicit content
Unauthorized use of copyrighted or trademarked material
Counterfeit goods
Misleading claims
False affiliation with brands, schools, organizations, celebrities, public figures, or businesses
Content that violates privacy, publicity, or personal rights
Products or content that Burbrand Marketplace determines are inappropriate for the marketplace

Burbrand Marketplace reserves the right to remove listings, cancel orders, suspend vendors, restrict customer accounts, or refuse service when this section is violated.

10. Orders and Payment

By placing an order, you agree to pay the listed product price, customization charges, shipping fees, taxes, and any other charges shown at checkout.

Prices may change at any time. Price changes will not affect orders already placed unless there was an obvious pricing error or technical error.

Burbrand Marketplace may use third-party payment processors to process payments. Burbrand Marketplace does not store full payment card details unless clearly stated by the payment provider.

Orders are subject to acceptance. We may refuse, cancel, or refund an order for reasons including suspected fraud, pricing errors, unavailable products, prohibited content, vendor issues, payment problems, or violation of these Terms.

11. Taxes

Customers are responsible for applicable sales tax, use tax, VAT, customs duties, import fees, or other government charges related to their purchase.

Tax amounts may be calculated at checkout based on the shipping address, billing address, product type, vendor location, or applicable law.

Vendors are responsible for complying with their own tax obligations, including reporting income, collecting or remitting taxes when required, and maintaining accurate business records.

12. Shipping and Delivery

Shipping times may include both production time and carrier transit time. Production times vary depending on the product, vendor, customization, print provider, order volume, and season.

Estimated delivery dates are estimates only and are not guaranteed unless expressly stated. Shipping delays may occur due to weather, carrier disruptions, address issues, customs delays, production delays, high order volume, or other circumstances outside our control.

Customers are responsible for providing a complete and accurate shipping address. Burbrand Marketplace is not responsible for orders delayed, lost, returned, or delivered incorrectly due to an inaccurate or incomplete address provided by the customer.

If an order is returned due to an address issue, refused delivery, or failure to pick up the package, additional shipping charges may apply to resend the order.

13. Order Changes and Cancellations

Because many products are printed or customized after checkout, order changes and cancellations are not guaranteed.

Customers should contact Burbrand Marketplace as soon as possible after placing an order if a change is needed. If production has not started, we may attempt to cancel or update the order. If production has already started, the order may not be eligible for cancellation, refund, or change.

14. Returns, Refunds, and Exchanges

Because many products sold on Burbrand Marketplace are made to order, customized, or printed specifically for the customer, Burbrand Marketplace generally does not accept returns or exchanges for reasons such as:

Ordering the wrong size
Entering incorrect personalization
Changing your mind
Selecting the wrong color or product
Providing a low-quality photo or image
Minor color or print placement differences
Delivery delays caused by the carrier
Gift recipient preference

However, we may offer a replacement, refund, partial refund, or store credit if an item arrives damaged, defective, misprinted, incorrect, or materially different from the order.

To request help with an order issue, contact us within 14 days of delivery and include:

Order number
Customer name
Clear photos of the issue
Description of the problem
Photo of the packaging, if relevant

Burbrand Marketplace may require photos, return of the item, vendor review, or print provider review before approving a replacement or refund.

15. Damaged, Defective, or Incorrect Items

If your item arrives damaged, defective, misprinted, or incorrect, please contact us at support@sefnalmarketing.com within 14 days of delivery.

If the issue is confirmed, Burbrand Marketplace may offer one of the following remedies:

Replacement item
Refund
Partial refund
Store credit
Other reasonable resolution

The available remedy may depend on the product, vendor, fulfillment partner, and nature of the issue.

16. Size and Fit

Customers are responsible for reviewing size charts before purchasing. Apparel sizing may vary by brand, product style, material, and manufacturer.

Size exchanges are not guaranteed for print-on-demand or custom products unless the wrong size was sent compared to the order confirmation.

17. Product Reviews

Customers may be allowed to leave reviews for products, vendors, or marketplace experiences. Reviews must be honest, accurate, and based on a real customer experience.

You may not submit fake reviews, paid reviews without disclosure, reviews on behalf of someone else, reviews intended to manipulate ratings, or reviews containing illegal, abusive, threatening, obscene, discriminatory, or misleading content.

Burbrand Marketplace may remove reviews that violate these Terms, contain spam, include private information, or appear fraudulent. We do not guarantee that every review will be published.

18. Vendor Responsibilities

Vendors are responsible for:

Providing accurate product listings
Using lawful images, designs, fonts, artwork, and product descriptions
Fulfilling orders within stated production timelines
Responding to marketplace support requests
Maintaining product quality standards
Complying with intellectual property laws
Complying with advertising, privacy, consumer protection, and tax laws
Resolving customer issues related to vendor products
Keeping business and payout information current
Avoiding misleading claims, fake reviews, or deceptive practices

Burbrand Marketplace may hold, delay, offset, or reverse vendor payouts when necessary due to refunds, chargebacks, fraud concerns, customer disputes, policy violations, suspected unlawful activity, or marketplace risk.

19. Vendor Fees and Payouts

Vendor fees, commissions, subscription charges, transaction fees, payout schedules, and marketplace deductions may be described in a separate Vendor Agreement, vendor dashboard, vendor onboarding document, or marketplace policy.

By selling on Burbrand Marketplace, vendors agree to pay all applicable marketplace fees and authorize Burbrand Marketplace or its payment partners to deduct applicable fees, refunds, chargebacks, taxes, or adjustments from vendor payouts.

Vendor payouts may be delayed, held, adjusted, or reversed when necessary due to customer disputes, refund requests, fraud concerns, chargebacks, incorrect vendor information, policy violations, or other marketplace issues.

20. Disputes Between Customers and Vendors

Burbrand Marketplace may assist with customer and vendor disputes, but we are not required to resolve every dispute in favor of either party.

We may review order details, product listings, customer messages, shipping information, photos, vendor records, and fulfillment data to determine a reasonable resolution.

Burbrand Marketplace reserves the right to issue refunds, replacements, credits, or other resolutions when we believe it is appropriate to protect customers, vendors, marketplace trust, or legal compliance.

21. Chargebacks

Customers agree to contact Burbrand Marketplace first to resolve order issues before initiating a payment dispute or chargeback.

Vendors may be responsible for chargebacks, payment disputes, refund costs, processing fees, and related losses connected to their products, listings, fulfillment issues, policy violations, or customer disputes.

22. Promotions, Discounts, and Gift Cards

Burbrand Marketplace may offer discounts, coupons, promotions, gift cards, or store credits. These offers may be subject to additional terms, expiration dates, product exclusions, vendor exclusions, or usage limits.

Promotions have no cash value unless required by law and may not be combined unless expressly allowed.

23. Third-Party Services

Burbrand Marketplace may use third-party platforms, payment processors, print providers, shipping carriers, analytics providers, apps, plugins, or vendor tools.

Your use of third-party services may be subject to their own terms and privacy policies.

Burbrand Marketplace is not responsible for third-party service interruptions, errors, delays, policy changes, or failures outside our control.

24. Privacy

Your use of Burbrand Marketplace is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal information.

25. User Conduct

You agree not to:

26. Disclaimer of Warranties

Burbrand Marketplace is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Burbrand Marketplace and Sefnal Marketing LLC disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

We do not guarantee that the website will always be secure, error-free, uninterrupted, or free from harmful components.

27. Limitation of Liability

To the fullest extent permitted by law, Burbrand Marketplace, Sefnal Marketing LLC, its owners, employees, contractors, vendors, partners, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from your use of the website, products, vendor services, shipping delays, customization errors, account issues, or third-party services.

To the fullest extent permitted by law, our total liability for any claim related to an order will not exceed the amount paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

28. Indemnification

You agree to defend, indemnify, and hold harmless Burbrand Marketplace, Sefnal Marketing LLC, its owners, employees, contractors, vendors, affiliates, partners, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

Your violation of these Terms
Your submitted content
Your product listings, if you are a vendor
Your violation of intellectual property, privacy, publicity, or other rights
Your violation of applicable law

29. Account Suspension or Termination

Burbrand Marketplace may suspend, restrict, or terminate customer or vendor accounts at any time if we believe the account has violated these Terms, created legal risk, harmed customers, misused the marketplace, engaged in fraud, or damaged marketplace trust.

If a vendor account is terminated, Burbrand Marketplace may remove listings, hold payouts as permitted by law or marketplace policy, cancel pending orders, or complete pending customer obligations.

30. Changes to These Terms

Burbrand Marketplace may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date.

Your continued use of the website after changes are posted means you accept the updated Terms.

31. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

Any disputes arising from these Terms, the website, marketplace services, vendor activity, or customer orders will be handled in the courts or dispute resolution forum located in Oakland County, Michigan, unless otherwise required by law.
